Under 501(a) of the Federal Tax Code, we submitted and have
pending an application for recognition as a tax-exempt
organization. A few weeks ago I sent additional info to the
IRS in repsonse to its request for a chronology of
activities.
While I was out of the country, the IRS contact for our
Tax-exempt Recognition application called several times.
The calls were requests for an additional document by which
the AGA agrees that its application should be considerd
under 501(c)4 (civic group or for the common good instead
of 501(c)7 (Fraternity, social club).
I placed a return phone call today -- so the contact person
will have a phone message response waiting for her on
Monday. There has been no mention by the IRS contact of any
additional application fee.
I plan to fax a letter stating that the AGA accepts
consideration under 501(c)4 as soon as I can get to a fax
machine -- (i.e., when the UPS Store opens). However, I
think that, for the records, we should have a vote since I
am taking this action for and on behalf of the Board.
So I move and subject to a seconding of the motion vote yes
that AGA agrees that its pending 501(a) application be
considered under 501(c)4 and that the Treasurer, for and on
behalf of the Board, send a notice of that agreement to the
IRS.
