Actually, *that's* were things get messy. That's mixing the
drawers. Is the error in one inherited/transferred from the
other?

Now that is a very interesting question. The sales tax in
VA is, I believe 5% as of September 1, 2004.

"Nonprofit organizations in Virginia are NOT automatically
exempt from sales and use tax. Before July 1, 2004, the
only way to be exempt from sales and use tax was to have a
member of the Virginia legislature present a group?s
request to the General Assembly and have it voted into law
thereafter becoming part of the Code of Virginia." 

Wow. Tough crowd!

I think this applied to collecting tax on purchases as well
as paying tax on purchases the organization makes.

Now there is an administrative application process. That
sounds better but I don't think GWAPA or AGA have
undertaken this step.

There is a provision in VA tax code that exempts
"Occassional Sales" but it specifcally does not apply to
events such as conventions or to organizations the
regularly sell stuff.

So it appears sales tax will have to be collected on all
the auction items, walk-in registrations, FTs, -- all of
it. It also means a temporary business or sales license
should be obtained.

It's conceivable that AGA might qualify to be exempt for
collecting sales tax -- I'm still looking for an applicable
provision in the code that doesn't require federal
recognition under 501(c)3. But even if exempt, AGA is
supposed to file and report the sales to the state.

Is GWAPA licensed to do sales in VA?
